GdPicture source code is protected by International copyright law.
This agreement is a license agreement between you and the author for the use of the computer software you have purchased (the "GdPicture Toolkit").
GdPicture Toolkit is any software based on the GdPicture source code.
By using the GdPicture Toolkit, you agree to be bound by all the terms and conditions of this license agreement.
Two different licenses are available for the GdPicture Toolkit:
Per-developer license: Each valid license key entitles a single developer to write software which accesses to the purchased GdPicture Toolkit.
Site license: This license entitles an unlimited number of developers in your organization to write software which accesses the purchased GdPicture Toolkit.
The GdPicture Toolkit can be distributed with your application on a royalty-free basis. This means that you can distribute as many applications using GdPicture Toolkit, as you wish without restrictions or royalties.
The GdPicture Toolkit may be used on any server, as long as access to the functionality of our components is via your own software. In other words, the public should not have direct access to the GdPicture Toolkit.
The GdPicture Toolkit may be installed on any third party hosting server as long as each developer using the GdPicture Toolkit has their own license key.
The GdPicture Toolkit may not be installed on a hosting provider's server with a single license key used by all the hosting provider's customers.
We request that you do not disclose your license key to third parties.
You are not allowed to sell the GdPicture Toolkit or your license key to other people.
You are prohibited from disclosing your license key to other people.
You are not allowed to use your license key into public web page (page which can be read outside of your organization).
This license is not a sale. Title and copyrights to the GdPicture Toolkit, accompanying Documentation and any copy made by you remain with the Author. Unauthorized copying of the GdPicture Toolkit or the accompanying Documentation or failure to comply with the above restrictions, will result in automatic termination of this license.
The GdPicture Toolkit may be embedded in any application or system developed by you or your organization and distributed without restriction.
The GdPicture Toolkit may not be used to develop commercial software toolkits, libraries or components for other developers.
The GdPicture Toolkit may also be distributed alongside your application. No royalties are payable for redistribution of the GdPicture Toolkit.
The GdPicture Toolkit may be used on any server on condition that public access to the Software is via your own application or software.
The GdPicture Toolkit may be installed on a shared hosting server, provided that each customer accesses the GdPicture Toolkit with their own license key.
You may not alter, decompile, disassemble, or reverse engineer the GdPicture Toolkit.
You may not remove, or alter the copyright notices.
You may not rent, lease, sub-license or transfer the GdPicture Toolkit, GdPicture Toolkit copies, Documentation, License Keys or your rights under this license without the prior written consent of the Author.
The Author's entire liability and your exclusive remedy under this warranty will be, at the Author's option, to attempt to correct or help you around errors with efforts which the author believes suitable to the problem, to replace the GdPicture Toolkit with functionally equivalent software, or to refund the purchase price and terminate this Agreement.
EXCEPT FOR THE PRIOR EXPRESS LIMITED WARRANTIES, THE AUTHOR MAKES, AND YOU RECEIVE, NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR IN ANY COMMUNICATION WITH YOU, AND THE AUTHOR SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE AUTHOR DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
IN NO EVENT WILL THE AUTHOR BE LIABLE FOR ANY DAMAGES, INCLUDING LOSS OF DATA, LOST PROFITS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING FROM THE USE OF THE SOFTWARE OR ACCOMPANYING DOCUMENTATION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOU ACKNOWLEDGE THAT THE LICENSE FEE REFLECTS THIS ALLOCATION OF RISK.
This agreement is the entire agreement between you and the Author, and supersedes any other communication or advertising with respect to the GdPicture Toolkit and related products. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
