This license entitles an unlimited number of developers in your organization to write software which accesses GdPicture Pro Imaging SDK. This license also includes the full source code of GdPicture Pro Imaging SDK.
GdPicture Pro Imaging SDK can be distributed with your application on a royalty-free basis. GdPicture Pro Imaging SDK can also be embedded into your application and the combined product may be distributed royalty-free.
GdPicture Pro Imaging SDK may be used on any server, as long as access to the functionality of GdPicture Pro Imaging SDK is via your own software. In other words, the public should not have direct access to GdPicture Pro Imaging SDK.
GdPicture Pro Imaging SDK may be installed on any third party hosting server as long as each developer using GdPicture Pro Imaging SDK has their own license key. GdPicture Pro Imaging SDK may not be installed on a hosting provider's server with a single license key used by all the hosting provider's customers.
We request that you do not disclose your license key to third parties.
You are not allowed to sell GdPicture Pro Imaging SDK or your license key to other people.
You are prohibited from disclosing your license key to other people.
You are not allowed to use your license key into public web page (page which can be read outside of your organization without authentication).
License Agreement
By using the software, you agree to be bound by all the terms and conditions of this license agreement.
This agreement is a license agreement between you and ORPALIS (the "Author") for the use of the computer software called GdPicture Pro Imaging SDK (the "Software") and/or the computer source code of GdPicture Pro Imaging SDK (the "Source Code"). The Software is protected by International copyright law.
This license is not a sale. Title and copyrights to the Software, accompanying Documentation and any copy made by you remain with the Author. Unauthorized copying of the Software or the accompanying Documentation or failure to comply with the above restrictions, will result in automatic termination of this license.
The Software may be embedded in any application or system developed by you or your organization and distributed without restriction.
The software may also be distributed alongside your application. No royalties are payable for redistribution of the software.
The Software may be used on any server on condition that public access to the Software is via your own application or software.
The Software may be installed on a shared hosting server, provided that each customer accesses the Software with their own license key.
You may amend the Source Code for your own needs; however the resulting source code may not be distributed outside your organization.
The Source Code may not be used to develop commercial software toolkits, libraries or components for other developers. You may not remove, or alter the copyright notices.
You may not rent, lease, sub-license or transfer the Software, Software copies, Documentation, Source Code, License Keys or your rights under this license without the prior written consent of the Author.
The Author's entire liability and your exclusive remedy under this warranty will be, at the Author's option, to attempt to correct or help you around errors with efforts which the author believes suitable to the problem, to replace the Software with functionally equivalent software, or to refund the purchase price and terminate this Agreement.
EXCEPT FOR THE PRIOR EXPRESS LIMITED WARRANTIES, THE AUTHOR MAKES, AND YOU RECEIVE, NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR IN ANY COMMUNICATION WITH YOU, AND THE AUTHOR SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE AUTHOR DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
IN NO EVENT WILL THE AUTHOR BE LIABLE FOR ANY DAMAGES, INCLUDING LOSS OF DATA, LOST PROFITS, COST OF COVER OR OTHER SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING FROM THE USE OF THE SOFTWARE OR ACCOMPANYING DOCUMENTATION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOU ACKNOWLEDGE THAT THE LICENSE FEE REFLECTS THIS ALLOCATION OF RISK.
This agreement is the entire agreement between you and the Author, and supersedes any other communication or advertising with respect to the Software and related products. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
